The Centers for Medicare and Medicaid Services (CMS) has recently altered a policy which may affect you and your loved ones. The policy in question originally stated that Medicare coverage is dependent on a beneficiary showing an improvement in health, and that if said beneficiary does not improve then they may no longer be eligible for Medicare coverage. However, in recent court case Jimmo v. Sebelius, the court ruled that a beneficiary need not show signs of improvement to be eligible for Medicare. Under the new policy, a beneficiary who requires skilled nursing and therapy services for maintenance of their health rather than improvement will be eligible for those services as well. CMS has stated it will undertake a nationwide educational campaign to inform health care providers, Medicare contractors, and Medicare adjudicators of the change in policy so that they do not limit Medicare coverage solely to beneficiaries who show medical improvement.
